Arkansas Takes Aim at PBMs with Groundbreaking Legislation

Arkansas is poised to become the first state in the nation to ban pharmacy benefit managers (PBMs) from owning pharmacies, a move that could set a precedent for other states. House Bill 1150, backed by the Arkansas Pharmacists Association, seeks to address what supporters call a longstanding conflict of interest—PBMs controlling drug pricing while profiting from their own pharmacy operations. As independent pharmacies struggle to stay afloat due to shrinking reimbursement rates, the proposed legislation has sparked a heated debate between those advocating for local pharmacists and PBMs defending their role in reducing drug costs.

APA CEO John Vinson emphasized the bill’s potential nationwide impact, stating, “I don’t see a scenario where any pharmacy—Walgreens, Walmart, an independent—is ever going to get a fair contract as long as CVS can steer and fill those prescriptions at their own pharmacy.”
